Karnataka State Administrative Tribunal

The need for establishment of Administrative Tribunals was first expressed by the Supreme Court in its judgment in RAMACHANDRAN SHANKAR DEVODHAR AND OTHERS v. STATE OF MAHARASHTRA reported in AIR 1974 SC 259. In that judgment the Hon. Supreme Court noticed alarming rise in number of cases pending in the Courts of law filed by Government officials agitating their grievances with regard to their service matters. In accordance with the provisions of Article 323A of the Constitution of India, Parliament of India enacted Administrative Tribunals Act, 1985.

Karnataka State Administrative Tribunal was established on 06.10.1986 vide Notification of Government of India bearing No. A 11019/20/86-A dated 03.10.1986. The scheme of the Act in its original form excludes the jurisdiction of High Courts and other Courts subordinate to it with regard to service matters. However, Hon. Apex Court in L. Chandrakumar v. Union of India declared that the decision of Administrative Tribunals are amenable to appellate jurisdiction of Jurisdictional High Courts, w. e. f. 18.03.1997.

Kerala Administrative Tribunal

It has come to notice of the Government that a large number of cases relating to service matters are pending before the Hon. High Court. Government, therefore, felt that the setting up of an Administrative Tribunal in the State to deal with service matters would go a long way not only to reduce the burden of the High Court and thereby giving more time to it to deal with other cases expeditiously but would also provide to the persons covered by the Administrative Tribunal speedy relief in respect of their grievances.

The Kerala Administrative Tribunal was set up in exercise of the powers conferred by sub-section (2) of Section 4 of the Administrative Tribunals Act 1985, by a notification published by Government of India. The Kerala Administrative Tribunal came into existence with effect from 26.08.2010, with issuance of notification dated 25.08.2010 by the Government of India and the appointment of Sri. K. Balakrishnan Nair as its Chairman by the President of India. The Government of India also by publishing notification bearing no.G.S.R.705(E) dated 25.8.2010 in Gazette of India (Extraordinary) Part II under section 3(i) dated 25.8.2010 declared August 26, 2010 as the "appointed day of" of Kerala Administrative Tribunal within the meaning of Clause (c) of Section 3 of the said Act.

Maharashtra Administrative Tribunal

In accordance with the provisions of Article 323A of the Constitution of India, Parliament of India, enacted Administrative Tribunals Act, 1985. Central Government issued a Government Gazette on 22nd April, 1988 for establishment of State Administrative Tribunal for Maharashtra State. Based on the same, Maharashtra Administrative Tribunal was established on 8th July, 1991. The Principal Bench of Maharashtra Administrative Tribunal is in Mumbai and its Benches are at Nagpur and Aurangabad.

The main objective of establishment of this Tribunal is to provide a speedy and efficacious remedy to all the employees of the Government of Maharashtra, nearly numbering around five Lakhs.

As per Section 15 of the Administrative Tribunals Act, 1985, this Tribunal has all the powers of High Court, with regard to all service matters of Government servants of the State of Maharashtra. This Tribunal has been vested with the power to take contempt action as per the provisions of Contempt of Court Act, 1971, as exercisable by High Court, as per Section 17 of the Act.

West Bengal Administrative Tribunal

West Bengal Administrative Tribunal was established on 16th January, 1995 at Bikash Bhavan, Salt Lake, Kolkata- 700091, West Bengal, India under the Administrative Tribunal Act, 1985. But in view of Hon'ble Court's injunction, it could not start functioning effectively before February, 1996.

The West Bengal Administrative Tribunal has been set up with the objective to speed up the disposal of cases relating to service matter of State Government Officers and Employees. Chairman of West Bengal Administrative Tribunal is the head of the Tribunal. A decision to modernize the activities of West Bengal Administrative Tribunal has been taken for its smooth and better functioning.
